Terms of Service

1. Acceptance of Terms

By accessing or using PAFS (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Platform. These Terms form a binding legal agreement between you and PAFS.

2. Eligibility

You must be at least 13 years old to use PAFS. The Platform is not directed at children under 13. If you are under 18, you represent that you have parental or guardian consent. We do not knowingly collect data from children under 13.

3. Accounts and Anonymity

PAFS is a pseudo-anonymous platform. You are not required to provide real names or personal information. You are responsible for maintaining the confidentiality of your account credentials. We may collect IP addresses and other technical data solely for security, moderation, and legal compliance. See our Privacy Policy (incorporated by reference).

4. User Conduct

You agree not to use the Platform to:

  • Post content that is illegal under U.S. law (including child sexual abuse material, threats, or fraud).
  • Harass, abuse, dox, or engage in targeted attacks against other users.
  • Spam, flood, or artificially manipulate visibility or engagement.
  • Circumvent moderation, IP bans, rate limits, or security measures.
  • Upload viruses, malware, or disruptive code.

5. User Content and License Grant

You retain ownership of content you post. By posting, you grant PAFS a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to host, display, reproduce, distribute, and modify your content solely as necessary to operate the Platform.

6. Moderation & Content Removal

PAFS is committed to free speech. We will not remove content based solely on viewpoint. However, we reserve the right to remove content or terminate accounts that violate these Terms or applicable law, or that threaten the Platform’s operation. We act in accordance with 47 U.S.C. § 230.

7. Intellectual Property

All Platform design, logos, and code (excluding user content) are owned by PAFS. You may not copy, modify, or create derivative works of Platform IP without express written permission.

8. Copyright Complaints (DMCA)

If you believe content infringes your copyright, please send a written notice to [insert legal@yourdomain.com] that complies with 17 U.S.C. § 512. We will promptly investigate and act as required by law.

9. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind. We do not guarantee uninterrupted access, data retention, or error-free operation. You are solely responsible for backing up your content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAFS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless PAFS, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Platform or your content.

12. Dispute Resolution

Any dispute arising out of these Terms shall be resolved by binding arbitration administered by the American Arbitration Association in Wilmington, Delaware. You waive any right to a jury trial or class-action participation. This clause is governed by the Federal Arbitration Act.

13. Governing Law

These Terms are governed by the laws of the State of Delaware without regard to conflict-of-laws principles.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the new Terms. We will post the updated date and, where feasible, notify registered users by email.

15. Termination

We may suspend or terminate your account for violation of these Terms or for any other reason. You may stop using the Platform at any time.

16. Miscellaneous

If any provision is held invalid, the remainder remains in effect. These Terms constitute the entire agreement between you and PAFS. No waiver of any breach shall constitute a waiver of any other breach.
